Terms of Service

1. Who We Are
ThreeByEight (“the Service”) is an Abel Solutions LLC product — a training app for mobile and the web. These Terms describe how you may use it.
2. Acceptance of Terms
By accessing or using ThreeByEight, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the Service.
3. Description of Service
ThreeByEight is a workout planning and training app, available as a mobile app and on the web. It helps you build training blocks (mesocycles), log lifting sessions, track bodyweight over time, and generates transparent progression suggestions from your own logged history. An account, created via Google sign-in, is required to use the Service.
We reserve the right to modify, suspend, or discontinue any feature of the Service at any time, with reasonable notice where practical. ThreeByEight is under active development; features may change between releases.
If we shut down ThreeByEight, we'll give you at least 30 days' notice where we can and refund the unused part of any prepaid web subscription. For app-store subscriptions we'll issue the refund through the store where it allows us to.
4. Eligibility, Account & Access
Eligibility. You must be at least 18 (or the age of majority where you live) to create an account or subscribe.
Sign-in is via Google only. You are responsible for maintaining the security of the Google account you use to sign in and for all activity that occurs under your account. Full use of the Service requires an active subscription (Section 5) — access is subscription-gated.
5. Subscription & Billing
ThreeByEight is offered on a subscription basis at $19.99/month or $119.99/year, plus applicable tax. Your first web subscription on an account includes a 14-day free trial; if you don't cancel before the trial ends, the paid subscription begins automatically. On the web, only one free trial is available per account: resubscribing after an earlier subscription has ended starts without a trial. In a mobile app, the app store decides trial eligibility under its own rules.
How you're billed depends on where you subscribe. If you subscribe in a mobile app, the app store you bought it from bills you (Google Play for the Android app). If you subscribe on the web, your subscription is sold through Link, Stripe's merchant-of-record service. Link is the merchant of record for that purchase: it charges you, calculates and collects any applicable tax, sends your receipts, subscription confirmation and renewal reminders, and handles payment support and disputes, under the payment terms shown at checkout. Your card statement shows LINK.COM* THREEBYEIGHT. However you subscribe, Abel Solutions LLC provides the Service itself, and we never receive or store your payment card details. Web subscriptions are available only to customers with a billing address in the United States. For a web purchase, Link's payment terms shown at checkout govern the payment itself — charging, tax, receipts and payment disputes — and these Terms govern the Service. If the two conflict about a payment, Link's terms apply to that payment.
Subscriptions auto-renew at the end of each billing period unless cancelled beforehand. A subscription bought in a mobile app is managed in that app store's subscription settings (for Google Play: Play Store → Payments & subscriptions → Subscriptions). A web subscription is managed from Profile › Manage or cancel subscription, or from your Link account at link.com. Cancellation stops future renewals but takes effect at the end of the current billing period — you keep access until then, with no partial-period credit.
Price changes. If we change the price of a web subscription, we'll email you between 7 and 30 days before your first renewal at the new price, with the new price and how to cancel. If you cancel before that renewal, you're never charged the new price. If the law where you live gives you more — for example, a refund after a price increase you didn't agree to — you get that. Price changes to a subscription bought in a mobile app store follow that store's price-change process.
Refunds. We don't refund partial subscription periods. Cancelling stops your next renewal, and you keep full access until the end of the period you've already paid for. If you think you were charged in error, email support@threebyeight.app and we'll look into it — we can issue refunds for purchases made on Google Play or on the web. Web purchases may also be refunded by Link under its own policies (see Link support), just as purchases made through an app store may be refunded directly by that store under its own refund policy (see Google Play's refund policy). Nothing here limits any refund rights you have under the law where you live.
6. Not Medical Advice
ThreeByEight is a training-planning tool, not a medical device or health service. The workout suggestions, load prescriptions, and progression math it produces are algorithmic estimates derived from the training data you log — they are not medical advice, and they are not a substitute for guidance from a doctor, physical therapist, or qualified fitness professional.
Consult a healthcare or fitness professional before starting any new training program, particularly if you have an existing injury, medical condition, or other reason to exercise caution. You use the Service, and any suggestion it produces, at your own risk, and you are solely responsible for listening to your own body during training.
Strength training carries an inherent risk of injury. Stop and seek medical help if you feel pain, dizziness, chest pain, or shortness of breath. By using ThreeByEight you accept those inherent risks of training.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to gain unauthorized access to any part of the Service or its underlying infrastructure.
- Attempt to access another user's account or training data.
- Circumvent or attempt to circumvent the Service's subscription gating.
- Scrape, crawl, or otherwise harvest content from the Service through automated means without our prior consent.
- Abuse or overload the Service's infrastructure in a manner that degrades service for other users.
We reserve the right to suspend or revoke access for accounts that violate this policy.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Training suggestions are only as good as the data you log; you are responsible for validating that any prescribed weight, rep count, or session plan is appropriate for you before performing it.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ABEL SOLUTIONS LLC AND ANYONE INVOLVED IN BUILDING OR OPERATING THE SERVICE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING ANY INJURY ARISING FROM TRAINING PERFORMED USING THE SERVICE — WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICE.
In plain English: our total liability to you for any claim arising from or related to the Service is limited to the greater of $50 or the amount you paid for the Service (whether to us, to Link, or to an app store) in the twelve (12) months before the claim arose.
Nothing in these Terms excludes or limits liability that the law doesn't allow us to exclude or limit — for example, for fraud, gross negligence, or wilful misconduct, or, where the law says so, for death or personal injury caused by negligence.
10. Termination
You may stop using the Service at any time, and may delete your account per our Privacy Policy — see Account deletion. We may suspend or terminate your access to the Service for violation of these Terms, including the Acceptable Use section above. Terminating your account does not entitle you to a refund beyond the refund terms in Section 5 that apply to your purchase. Deleting your account cancels a web subscription immediately, without a refund for the rest of the period.
11. Changes to These Terms
We may update these Terms. If a change materially affects your subscription or your rights, we'll tell you by email between 7 and 30 days before it takes effect, and explain how to cancel. If you don't agree, cancel before the change takes effect — you keep access until the end of the period you've paid for. Other changes take effect when we post them here with a new effective date.
12. Governing Law & Disputes
These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law rules. Before filing a claim, please email support@threebyeight.app so we can try to resolve it; we'll respond within 30 days. Any claim may be brought in the small claims court where you live; otherwise, claims must be brought in the state or federal courts located in Minnesota. If you're a consumer, this doesn't take away any right you have to sue where you live.
